You are prohibited (under the criminal statute 18 U.S.C. 203) from receiving, either directly or indirectly, any compensation for any "representational services" in connection with a particular matter in which the Untied States is a party or has a direct and substantial interest. This applied equally to representational services you render personally or by another another person (provided that the you share in the compensation for those services).

The prohibition attaches if the covered representational services were provided at the time when you are a Government employee. It does not matter whether or not YOU provided the represenational service, you still cannot accept compensation and the nonfederal entity cannot provide the compensation. Doing do violates this criminal statute. The term "representational service" means communications to or appearances before Federal entities (not just EPA) with the intent to influence the Government on behalf of a third party. Typical examples include include legal and consulting services,

Example: You join the law firm Dewey, Cheatham & Howe after leaving EPA. You can't share in any fees attributable to representational services provided by the firm while you were employed by the Government. This also means that your compensation plan can't include any firm profits, partnership interests or bonuses where such compensation derive in any part from covered representational services. The firm is also prohibited from providing this compensation.
