SIP Requirement Blank Deadline Dates

There are situations where a required SIP element may not have a deadline listed. Examples are:

  1. On June 8, 2007, the United States Court of Appeals vacated the Subpart 1 portion of the Phase 1 Rule (Court Order). On May 14, 2012, the Former Subpart 1 nonattainment areas were classified under Subpart 2 ( 77 FR 28424), effective June 13, 2012. As a result of this, the SIP requirement deadlines for the former Subpart 1 nonattainment area are no longer in effect.

  2. The "Severe/Extreme Area Fee Program (Section 185)" required SIP element does not have a deadline. The 1990 CAA Amendments set a deadline of December 31, 2000 for 1-hour Ozone 185 Fee program SIP requirements, but do not address deadline periods for future Ozone NAAQS revisions for the 185 Fee elements.

  3. If a State requests that a nonattainment area be reclassified to a higher classification, additional SIP elements may be required as a consequence of approval of the reclassification. If the State submits SIP revisions for additional requirements prior to the reclassification approval, there is no need to establish a deadline for any other SIP revision requirement. If any part of the SIP is disapproved, EPA may establish due dates.

  4. Tribes are not subject to mandatory submittal deadlines for certain planning requirements for an area designated nonattainment for one of the NAAQS. See 63 FR 7254 (February 2, 1998).

  5. The enhanced monitoring (PAMS) required SIP element does not have a deadline. The Clean Air Act requires certain SIPs to contain measures to improve the ambient monitoring of NOx and VOCs, but does not establish a deadline for such SIP submittals.
