Municipality means a city, town, borough, county, parish, district, association, or other public body created by or under State law and having jurisdiction over disposal of sewage, industrial wastes, or other wastes, or an Indian tribe or an authorized Indian tribal organization, or a designated and approved management agency under section 208 of the CWA.

EPA has the authority under 40 CFR 122.26 (a)(1)(v) to designate storm water discharges from certain facilities as requiring permit coverage even if those facilities are not categorically subject to Phase I permitting requirements. The regulation provides that the Director of the NPDES program may determine that the discharge or a category of discharges within a geographic area contributes to a violation of a water quality or is a significant contributor of pollutants to waters of the United States.

uncontrolled sanitary landfills

An uncontrolled sanitary landfill is a landfill or open dump, whether in operation or closed, that does not satisfy the runon/runoff requirements established pursuant to subtitle D of the Solid Waste Disposal Act. However, landfills closed prior to October 9, 1991 are not subject to the Resource Conservation and Recovery Act (RCRA) runon/runoff requirements, and therefore need not submit storm water permit applications if they are located in municipalities of less than 100,000 population. Landfills closed after October 9, 1991and others that meet the above definition would be subject to the storm water permit application requirements.
