Hazardous Waste Electronic Manifest System (“e-Manifest”)
For over a decade, the US EPA, states, industry and related stakeholders have had a mutual interest in developing a national electronic manifest system that would facilitate the electronic transmission of the uniform manifest form and make the use of the uniform manifest much more cost-effective and convenient for users. On October 5, 2012, President Obama signed into law, the Hazardous Waste Electronic Manifest Establishment Act (PDF) (8 pp, 1.6 Mb) which authorizes the US EPA to implement a national electronic manifest system. Commonly referred to as "e-Manifest", this national system is envisioned to be implemented by the EPA in partnership with industry and states.
Pre-Solicitation Notice Posted
The pre-solicitation notice (including Statement of Objectives) for the e-Manifest procurement was posted to the FedBizOpps.gov website on May 19, 2015.
e-Manifest Advisory Board Call for Nominations
Through a Federal Register notice, the EPA invited nominations of qualified candidates to be considered for a three-year appointment to the Hazardous Waste Electronic Manifest System Advisory Board. Nominations were due on or before March 20, 2015.
The EPA hosted a webinar on Thursday, November 20th to provide an update on the implementation of the Hazardous Waste Electronic Manifest Establishment Act program. The webinar provided an update on the various fronts of the program (e.g., regulatory, system, advisory board), as well as general timing and next steps. In addition, the webinar was an opportunity to briefly update a wider audience on detailed technical discussions that have been held with state and industry stakeholders regarding the technical architecture for the e-Manifest system.

The Final Rule will authorize the use of electronic hazardous waste manifests that will become available when EPA establishes a new electronic hazardous waste manifest system (e-Manifest). The modification will provide waste handlers with the option to complete, sign, transmit, and store manifest information electronically in the electronic system. States that currently receive and collect paper manifest copies will receive copies of manifest data electronically from the system.

Milestones for EPA Actions:
The Act requires that the e-Manifest Information Technology (IT) system must be up and running within three years after the Act is passed
The EPA must issue regulation authorizing use of electronic manifests within one year after the Act is passed
The EPA must establish a System Advisory Board within three years after the Act is passed in order to advise the EPA on system performance and user fees
e-Manifest extends to all federally- and state-regulated wastes requiring manifests
Allows that the use of electronic manifests is optional for users, and authorizes centralized collection of data from electronic and paper manifests
Fee and spending provisions:
- Authorizes the EPA to collect reasonable user fees for all system related costs including development and maintenance
Oversight: Requires that the EPA conduct annual Inspector General (IG) audits and submit biennial reports to Congress
Consistency: The Act requires that EPA must establish a uniform effective date in all states for e-Manifest, and must implement e-Manifest until States are authorized
Rulemaking and System Planning
Pursuant to the Hazardous Waste Electronic Manifest Establishment Act, EPA is required to promulgate a final regulation authorizing the electronic tracking of hazardous waste shipments. The Act was enacted on October 12, 2012 and mandated that EPA issue an e-manifest regulation by October 5, 2013. EPA worked rigorously to meet the October 2013 statutory milestone, but promulgating a final rule in the one-year timeframe directed by the Act was an ambitious undertaking, given potential opportunities for delay inherent in any regulatory development process. EPA, however, considers the promulgation of this One Year Rule a few months after the statutory deadline to be a clear success.
Although EPA has completed a major step in moving toward e-Manifest, hazardous waste handlers cannot begin tracking their hazardous waste shipments electronically until EPA establishes the e-Manifest system. The Act calls for the system to be online by October 5, 2015. Although EPA has not received appropriated funding to date for this program, it is making significant progress in establishing the groundwork for the system. e-Manifest System Request for Information
During 2013 EPA issued two Requests for Information (RFIs) seeking input from contractors regarding capabilities, approaches, tools, and software or other components that would be relevant to the implementation of e-Manifest. For more information, please visit the e-Manifest RFI page.
e-Manifest System Requirements Gathering Meetings
Also during 2013, EPA held three face-to-face meetings intended to bring together e-Manifest stakeholders to discuss requirements for the e-Manifest system. In addition, EPA held separate webinars to discuss specific topics as needed,as well as to reach stakeholders not able to attend the face-to-face meetings. The purpose of the face-to-face meetings was to build off of the previous efforts to collect requirements (see e-Manifest previous activities) and engage stakeholders on current expectations and technical requirements. Each meeting was a day and a half.

This document describes the e-Manifest system's high level architecture and design approach, and how data will flow through the system. Aspects of this document are subject to change. EPA will be hosting outreach/communications webinars and/or meetings in FY 2014 with relevant stakeholders to discuss technical architecture design and related issues.
The purpose of the e-Manifest ListServ is to provide an open forum for the posting and discussion of news and information relating to the e-Manifest program. EPA will use this listserv to provide stakeholders with system and program announcements and updates. For example, when information changes on EPA’s e-Manifest website, a note will be sent out to the ListServ. This Listserv can also be used to facilitate e-Manifest conversations amongst the stakeholder and user community. Please note the code of conduct for the ListServ that is included in the welcome email you receive once you subscribe.
